Chapter 13 Fee Structure

Last month I wrote about the typical fee structure for a Chapter 7. This month I would like to shed some light on the typical fee structure for Chapter 13 Bankruptcies.

Consultation: Free
Attorney fee required to file the case: $100*
+ Court fee – required to file the case (as of December, 2023): $313
= Total amount required to file the case: $413* ($100 + $313)


“Filing the case” is the official start of your case. You get a case number, and protection from your creditors**.

In the Southern District of Ohio, there is a no-look attorney fee permitted for Chapter 13 bankruptcy cases. As of December, 2023, it is $4,350. This amount, minus the $100 up-front attorney fee, is paid via the Chapter 13 Plan payment over the next 3-5 years, depending on your circumstances. This means that the remainder of your attorney fee is included in the monthly payment you’ll be making to the Bankruptcy trustee over the next few years; in other words, it is not due up-front. It’s a nice way of deferring the cost of the case over a long period of time.
