Reminder: Bankruptcy Offers Great Benefits

When most people hear “bankruptcy,” they think of failure. I’m continually trying to fight that stigma, because it is unfair, inaccurate, and has a chilling effect on people actually using bankruptcy to improve their lives.

In consumer bankruptcy, especially Chapter 7 and Chapter 13, the law is designed to provide something positive: A fresh financial start. One interesting feature is the “automatic stay.” The moment someone files bankruptcy, creditors must immediately stop collection calls, lawsuits, wage garnishments, and even foreclosure proceedings. This legal pause can give Ohio families much-needed breathing room to regroup.

Another surprising fact is that not all property is lost in bankruptcy. Exemption laws allow debtors to keep essentials like a home*, car*, retirement accounts*, and personal belongings* (*See below).

Rather than a punishment, consumer bankruptcy can be a financial reset button—helping honest but struggling people rebuild, repair credit over time, and move toward stability with less stress.
